SCOPE OF WORK OF PENTAPRAXIS SOLUTIONS LLP:
1. Designing
1. Preparation of design brief with all requirements as provided by clients.
2. Measurement and documentation of actual site dimensions and conditions.
3. Preparation of layout options.
4. Final layout for approval from client.
5. Preparation of CAD 3D model for understanding of designs and space.
6. Finalization of specifications for all items
7. Material selection with approval of materials and makes for items wherever required.
8. A detailed BOQ / final estimate for all jobs as per finalised specifications
9. Preparation of timelines for execution of work
10. Preparation of working drawings for (as and if needed by the scope):
a) Furniture layout drawing
b) Civil and masonry details for construction of walls
c) Tiling drawings all floors and dado
d) False ceiling drawings and specific details if any
e) Electrical layout drawings and details
f) Furniture drawings and details
g) HVAC drawings and details
h) Plumbing drawings and details
i) EPBAX drawings and details
j) Firefighting system drawings and details
k) Access Control System drawings and details
l) CCTV layout and details
2. Material Supply
1. Listing required material as per the BOQ and/or selection
2. Ordering the appropriate quantity of material as required
3. Checking and maintaining the delivered material
3. Execution / Erection
1. Timely supervision of site progress
2. Supply of labour, tools and tackles for execution of work on site
3. Preparation and submission of periodic invoices for execution and erection
4. Regular site visit by principal designers
5. Periodic carting of all extra material on completion of execution
4. Exclusions or Client’s scope
1. Communication with concerned authorities for necessary permissions if required.
2. Providing electricity and water supply during execution of work.
3. Provision of electronic devices unless otherwise specified in BOQ.
PROJECT COST
1. Please refer Bill of Quantities for budgetary estimate for the project.
2. GST, other local taxes and duties, if any, will be charged extra as OR if applicable.
3. Delivery related charges such as cartage, loading-unloading and vahtuk hamali shall be charged extra as OR if applicable. Mathadi Union Charges are applicable at certain parts of the city, which shall be payable at actual by the Client.
PAYMENT TERMS
1. All cheques to be drawn in favour of ‘PENTAPRAXIS SOLUTIONS LLP’ (GSTN 27ABCFP9991Q1Z2)
2. GST on other project items will be applicable as per specific items
3. All payments to be made against bills submitted by ‘PENTAPRAXIS SOLUTIONS LLP’ only.
4. No amounts shall be directly paid to any agencies or contractors.
5. Any sizes, quantities, materials or designs which differ from that considered in the BOQ, will result in change of the final payable billing amount.
6. Payment for all items to be divided into 3 parts:
a) Professional fees
b) Material supply
c) Execution on site
7. Item-specific advance payments and/or immediate payments shall be required for placing the order.
8. Delay in payment of advance would cause delay in placement of order for certain items, consequently delay in project handover.
9. Balance payment for material supply to be made within 2 days upon delivery of material on site.
10. Unless specified, 70% of item cost to be paid as material costs on delivery of material on site.
11. Unless specified, 30% of item cost to be paid as execution costs.
12. All bills and/or other documents will be submitted on the branded stationary of the firm.
13. In case of delay in payment, PENTAPRAXIS SOLUTIONS LLP shall have the right to suspend work on site till pending payment is cleared.
GENERAL TERMS
1. One (1) set of printouts of all working drawings will be prepared by the firm free of cost.
2. The estimate given is valid till 30 days from date of issue.
3. The fees and estimate mentioned are strictly in connection to the specific project and shall not be applied or adjusted for any other project, in any situation. Whatsoever.
4. Any revision in the drawings, tenders and documents, once signed and approved, required to be made by the client shall be compensated as additional services rendered by the firm and paid for on mutually agreed terms.
5. In case of any additions or changes in the final scope of work, the value of the contract will be enhanced accordingly and payment will be made in accordance with terms of payment.
6. In line with our policy of continual improvement we reserve the right to modify the design and charge the specifications of any material if in our opinion such modification constitutes an improvement and/or is in accordance with revised standards or manufacturing methods.
7. In case of non-availability of any specified makes in the market, we reserve the right to right to change the specification within the same quality and cost bracket with approval from client.
8. Although the team works with utmost safety precautions, we will not be responsible for labour or workmen injury and/or death on site. Their insurance and safety are the sole responsibility of the respective contractors and/or agencies.
9. PENTAPRAXIS SOLUTIONS LLP won't be responsible for delay caused due to material shortage and/or insufficient advance payments and/or finalised design modifications and/or changes requested by the Client during or after work execution.
10. Storage of material shall be on site conducive to storage. Provision of a lockable entrance door for security of material shall be responsibility of Client. Provision of security personnel on site is optional, and is not within the scope of the firm.
11. Extra material will be supplied to site to ensure no shortages are faced on site. This excess material shall be the property of PENTAPRAXIS SOLUTIONS LLP, and shall be taken back by the firm on completion of work. Removal of any extra goods, supplies, material etc. upon completion shall be let removed from site without any hindrance by client.
12. Ownership of property in all material/supplies/equipment etc. brought to site in execution of the project shall at all time lie with PENTAPRAXIS SOLUTIONS LLP notwithstanding the fact that progress bills have been paid for. The ownership rights in the job performed shall get diverted from PENTAPRAXIS SOLUTIONS LLP to the client only upon full payment of all dues of PENTAPRAXIS SOLUTIONS LLP and upon the site being formally handed over, until which PENTAPRAXIS SOLUTIONS LLP reserve the right to remove, take away, sell, mortgage or scrap all material/supplies/equipment etc. brought to site in execution of the project without any hindrance by client.
ARBITRATION:
1. Any dispute with respect to outstanding payment shall be subject exclusively to Pune MSME facilitation council.
2. Any other dispute shall be submitted to a mutually appointed sole arbitrator at Pune.
3. For civil and criminal proceedings, all concerned disputes are subject to Pune Jurisdiction only.
WARRANTY:
1. The warranty for the material supplied against faulty material will be for a period of 12 months from handover or as given by the supplier. No warranty shall be applicable for material whose warranty is not provided by the supplier.
2. Any electrical, paint or glass item is not covered by this warranty, unless otherwise specified by the respective supplier.
3. The warranty for the workmanship against defects in manufacturing will be for a period of 12 months from the date of handover.
4. The obligation under this warranty will not be applicable in case of damage due to neglect, misuse, physical damage, water damage, fire damage, pets damage or faulty operations.
5. Warranty shall be applicable only upon full payment of project, even if the project is handed over. PENTAPRAXIS SOLUTIONS LLP shall bear the rights to terminate any and all warranties in case of non-payment of dues.
6. No other warranty other than stated above will be applicable or implied to be applicable. PENTAPRAXIS SOLUTIONS LLP are not liable for any consequential damages.
7. A paid Annual Maintenance Contract (AMC) will be optional at the end of the 12 months period for maintenance and upkeep of the premises. The cost of the AMC will be decided upon mutual agreement of the client and the firm.
SUSPENSION/CANCELLATION/TERMINATION OF WORK:
1. PENTAPRAXIS SOLUTIONS LLP shall be entitled to suspend/cancel the work on account of client instructions/lack of instructions and/or non-payment of our bills.
2. If work or part of work is cancelled after client’s acceptance, cancellation charges as levied by our suppliers shall be borne by the client. In addition, the client shall reimburse the cost and expenses incurred by the firm up to the date of cancellation plus ten percent.
3. The project cannot be terminated unilaterally. In case the project has to be terminated, both parties have to discuss and agree on the compensation to be paid to the designer and contractor(s).
RETURNS AND REFUND POLICY:
1. PENTAPRAXIS SOLUTIONS LLP keeps a window of 24 hours for 100% refund of project booking amount.
2. Products purchased from our website store, offline store, exhibition stalls, etc. are not eligible for any returns & refunds unless any manufacturing defect or damage in transit is observed. Such observations shall need to be pointed out by our customers through our WhatsApp phone number.
3. Tax, shipping & packaging cost shall not be refunded under any circumstances whatsoever.
OWNERSHIP OF COPYRIGHT AND IPR:
1. Design is an intellectual property of the designer. The drawings, specifications, documents and models as instruments of service are the property of PENTAPRAXIS SOLUTIONS LLP whether the project, for which they are made, is executed or not.
2. The client shall retain copies of the Designer’s model, drawings, specification and other documents for their information and use in connection with the project. These shall not be used for any other project by the client or any other person whatsoever.
3. The ‘PENTAPRAXIS’ branding, logo, wordmark and trademark are the property of PENTAPRAXIS SOLUTIONS LLP, and shall not be used by anyone without the firm’s written consent whatsoever.
4. PENTAPRAXIS SOLUTIONS LLP may use the Client’s feedback or email replies for business development purposes. Clients hereby assign ownership of all such content, and acknowledge that PENTAPRAXIS SOLUTIONS LLP can use and share such content for any purpose in its sole discretion.
